What we're asked most about Digital contracts.

Are digitally signed contracts legally valid?
Orkasa <strong>is not e-signature</strong>. The client signs the PDF however they prefer (printed or on PDF with Markup/Acrobat) and returns it to you. The validity of a client-signed PDF is the same as signed paper: written evidence of consent. Orkasa logs UTC timestamp + IP + user-agent when the client opens the link, which is evidence of delivery and reading. For qualified e-signature validity (notarial equivalence) you'd need a certified PSC provider per country, which we don't offer today.
Can I add custom clauses or only use the templates?
Yes · the Full plan includes 3 pre-built templates (exclusive mandate · purchase agreement · lease) that you can edit freely before sending to the client. <strong>An advanced editor to create custom templates from scratch is on the roadmap (Brokerage plan)</strong> — for now you can upload a Word PDF conversion and send it manually.
What happens if a party doesn't sign or delays?
The PDF link expires in 7 days (configurable). <strong>Automatic WhatsApp + email reminders are on the roadmap</strong> — for now if the client doesn't return the signed PDF in 48h you can resend manually from the deal. The audit log records every client view (timestamp + IP + user-agent). No signed file returned · no financial penalty.
Does it integrate with my notary for cases that require notarization?
Yes · the client-signed PDF + the send/view audit log can be downloaded in one click from the deal and are suitable to hand to the notary who will execute the public deed (for real estate purchase agreements requiring Public Registry filing). <strong>Direct integration with partner notaries is on the roadmap</strong> — for now you coordinate with your usual notary. Notary fee ~$80-150 depending on the country.
Who keeps the contracts in custody? Does it comply with tax regulations?
Signed PDFs are stored in Supabase Storage with AES-256 encryption and strict RLS: only your agency's agents see them. <strong>Custody as long as the account is active</strong> · downloadable in one click from the deal. For multi-year retention required by specific tax regulation in your country, the Enterprise plan lets you replicate storage on your own AWS / Azure.
How does it integrate with the KYC flow?
Before generating the contract, Orkasa LATAM Compliance verifies the client: ID/tax-number against official records · OFAC and local AML/FIU lists · PEP screening. If they pass, the contract can be generated. If triggered on transactions >$10K (per-country thresholds), an STR is generated automatically for your compliance officer. <strong>Without a KYC OK · the contract can't be sent to the client</strong>. This protects your agency legally.
How do you guarantee the PDF wasn't altered after signing?
The client-signed PDF is stored in Supabase Storage under strict RLS policies: read-only for brokerage agents, no update or delete once uploaded. Send metadata (UTC timestamp, IP, user-agent of the client when they opened the link) stays in the database. <strong>It's consistent evidence of delivery, reading and return of the document</strong>; the validity of the client's signature itself depends on the civil law applicable to the contract.
Can the client sign from their iPhone or only a computer?
Yes · iPhone, Android, iPad, MacOS, Windows · any device with a browser and a PDF reader. No app download · no Orkasa account. The client receives the link via WhatsApp + email, opens it, reads the PDF, signs it however they prefer: on iPhone/iPad with <em>Markup</em>, on Android with <em>Adobe Acrobat</em> or <em>Xodo</em>, on laptop with Preview (Mac) or Adobe Reader. Or print, sign with a pen and scan with their phone camera. <strong>Forward via WhatsApp · done</strong>.
Can I migrate my current contracts from DocuSign?
Yes · if you have Word templates of your current contracts you can upload them and our team converts them to editable templates identifying CRM-fillable variables (1 day setup). <strong>Bulk import from DocuSign / HelloSign / Adobe Sign is on the roadmap</strong> · for now it's manual contract-by-contract if you want to migrate the historical archive.
